Two documents are often confused. A master service agreement and a statement of work are a pair, not alternatives: the MSA carries the legal terms and the SOW carries the project. A consulting agreement and a contractor agreement look similar, but the first is written around advice and the second around output and employment status. When in doubt, pick the one whose clause list matches what you would argue about if the relationship went wrong.
What makes a signed document hold up
Electronic signatures have been enforceable in the United States since the ESIGN Act in 2000, and across the EU and UK under eIDAS. Neither framework asks for a particular technology. Both ask you to be able to show five things.
Intent to sign
The signer has to mean it. CalmSign asks for a deliberate act — drawing or typing a signature and confirming it — rather than treating a page view or a click-through as agreement.
Consent to sign electronically
Both the ESIGN Act in the United States and eIDAS in the EU and UK expect the signer to agree to do business electronically. That consent is captured on the signing page, before anything is signed.
Attribution
The signature has to be tied to a person. Each signer gets their own unique link, and the audit trail records the email it went to, the IP address, the device, and the timestamp of every step.
Association with the record
The signature must stay attached to the exact document that was signed. On completion CalmSign snapshots the document and computes a SHA-256 hash over it, so the seal breaks if a single character changes later.
Record retention
Both sides need a copy they can keep and reproduce. The owner is emailed the completed document, the signer can download it from their link, and the audit trail travels with it.
